Board sets Oct. 10 hearing in complaint against Mayor Doug Denny, orders new subpoenas

The board scheduled an evidentiary hearing in the pending complaint against Mayor Doug Denny for 10 a.m. on Oct. 10, 2025 and directed board counsel to issue new subpoenas to witnesses previously summoned for a September hearing. The board convened in open session to act on matters from its closed session and to set pre-hearing procedures.

The board unanimously voted to deny a motion to reconsider a prior ruling. The chair moved to deny the motion "for reasons previously stated on the record" and members signaled unanimous support by raising their hands.

The board also voted unanimously to defer ruling on a second motion to dismiss. The motion to defer was described as preserving the right to bring the motion back if the proceedings do not occur as planned.

Board members discussed subpoenas the board had issued for a hearing originally set for Sept. 5 and noted those dates are now past because the hearing was adjourned to a date no later than Oct. 10. Attorney Eric Larson, the board's counsel, told the board, "We'll need to issue new subpoenas." The board asked Larson to draft those subpoenas and send them to staff member Cody for service.

At the Sept. 3 meeting the board learned that the respondents' attorney, Andrew Erlinson, and the board's counsel had developed an agreed statement of facts; as of the Oct. 3 discussion, neither side had provided a signed copy to the board.

During scheduling discussion, Attorney Andrew Erlinson informed the board that "Mayor Denny has signed the resolution authorizing additional funds to be used for paying attorney's fees for Mr. Hall," and that he believed another signature had been provided to Mr. Hart. The board did not take a separate formal vote on that resolution during this session; Erlinson offered that information to inform scheduling.

The board voted to hold an additional pre-hearing meeting at 3:30 p.m. on Oct. 3 to discuss hearing procedures and any outstanding discovery issues, including whether depositions of the city clerk and city attorney will occur before the hearing. Board members said holding the meeting would save time at the start of the hearing and provide an opportunity to address procedures and late motions.

There were no other formal actions. The board adjourned after approving the Oct. 3 meeting and setting the Oct. 10 hearing date.
