The Board of Zoning Appeals approved a special exception on Sept. 15 permitting the construction of a single-family residence on a 6.3-acre parcel at 345 South 775 East. Planning staff recommended approval, noting the parcel lies in an agricultural (AG) zoning district that already contains single-family homes and that the town’s comprehensive plan designates the area for limited residential development. Staff also noted the lot split is being exercised under the subdivision-control ordinance’s one-time exemption and that the proposed home must still receive an improvement location permit (ILP) to ensure compliance with applicable development standards. Petitioners Trevor and Natalie Peters told the board they have a purchase agreement contingent on approval and expect to build a single-story residence with an attached garage in the future. The couple said the site contains open land, tree lines and a small creek, and that a soil test within the last five years confirmed a suitable septic field location. No members of the public spoke in opposition at the hearing, and staff reported letters of concern received earlier about potential future subdivisions but clarified any additional lots would require separate plan commission and BZA approvals. The board voted unanimously to approve the special exception based on staff findings and the evidence presented.
