Routt County commissioners on Oct. 21 approved a supplemental agreement to add a legal description of the Justice Center wetlands to a perpetual wetlands easement created in 2005.
County legal staff explained the Justice Center wetlands and a separate Klein Wetlands were part of the same mitigation project tied to the Justice Center construction. The original 2005 easement required that, upon completion of mitigation work, a survey be conducted to delineate wetlands and that the legal description be added to the easement. According to staff, the required delineation survey was not completed until 2025. County counsel and staff worked with the Yampa Valley Land Trust and a wetland specialist who originally flagged and mitigated the wetlands to complete the survey and prepare the supplemental agreement adding the legal description into the conservation easement package.
Commissioners cast a voice vote authorizing the chair to sign the supplemental agreement to the 2005 perpetual wetlands easement with Yampa Valley Land Trust LLC; the meeting record shows the motion, a second and unanimous approval.
Staff said the supplemental agreement aims to create a “clean package” by including the survey‑based legal description in the permanent easement records. No new mitigation or construction was authorized by the action; the agenda item documents only record the addition of the legal description to the existing easement.
