The Port Orange Planning Commission voted to reconsider its prior action on a Land Development Code text amendment for Chapter 15 (Case DCAM-24-0002) so one commissioner who previously abstained could cast a vote.
The move on Aug. 28 was described by the city attorney as a procedural, curative measure; the attorney said there was "no need to redeliberate" because the substance had been discussed at the prior meeting. "This action's a curative measure to ensure a proper vote on the record," the city attorney said.
Commissioners cast the roll-call vote after the motion and second were recorded on the meeting record. The tally was: Stan Smith — yes; Daniel Malaga — no; Marie Wilson — yes; Tom Sorensen — yes. The motion carried 3-1. There were no public comments on the reconsideration when the commission called for them.
The commission chair framed the item as limited to correcting the record so the member who had abstained at the previous meeting could participate. Meeting minutes from the July 31, 2025 meeting were referenced earlier in the session; the attorney said the earlier abstention was reviewed and determined not to be a legal conflict. The commission did not reopen debate on the text amendment itself.
No additional documents, amendments to the text amendment, or referrals were made during the Aug. 28 action. With the vote recorded, the commission concluded its business and adjourned the meeting.
Minutes and staff records should reflect the change in voting eligibility and the completed roll-call vote on the motion to reconsider.
