The Miami Beach Planning Board concluded a progress report Oct. 7 for the neighborhood-impact conditional use permit covering the ground-floor space at 2038 Collins Avenue, accepting a change-of-operator affidavit and acknowledging that no complaints or code violations have been issued for the space.
Planning staff said the conditional use permit originally governing the space dates to December 2015 (for Bagatelle) and was later modified when Rasputin became the operator in June 2021. The current operator, CAD Hospitality LLC, submitted the required affidavit and staff recommended closing the report because there were no outstanding compliance issues. Attorney Samuel A. Rupert, representing CAD Hospitality, told the board the principal of the operator was present and asked the board to “close out the progress report.”
Chair members moved and the board voted to conclude the progress report. The action records no outstanding violations and does not change any conditions of the CUP other than acknowledging the operator change.
The planning department said it will continue to monitor compliance under the existing conditional-use conditions and will reopen review if future complaints or violations arise.
