Commission moves to clarify 2% appropriation threshold, grant treatment and referendum wording

The commission discussed proposed charter language intended to clarify that any appropriation equal to or greater than 2% of the annual budget must appear as a separate automatic referendum question, whether that appropriation is in the annual budget or is a supplemental appropriation.

Board of Finance members and counsel said the suggested revision would align the charter with current practice and avoid confusion when large projects are included in the annual budget rather than submitted as separate referendum items. As explained by a Board of Finance representative, "what this language would do is simply clarify it and it's consistent with current practice, which is that regardless of whether it's in the annual budget or as a supplemental appropriation, an appropriation that large has to be approved in a separate referendum item." Commissioners discussed the public'facing implications: bundling multiple projects in a single referendum question can confuse voters, so commissioners asked staff to draft clearer referendum explanatory text that lists funding sources and local share amounts.

The meeting also addressed whether grant-funded projects should be excluded from the 2% threshold. Counsel and staff explained that an appropriation is a legal cap on total spending and that grants count toward the appropriation regardless of funding source; the transcript record noted, "an appropriation is a legal cap in the amount of spending. It doesn't talk about where the spending is from." Commissioners agreed to ask town staff and counsel to draft referendum explanatory language that makes funding sources and shares transparent while preserving the policy that total project cost counts toward the appropriation threshold.
