Sugar Grove board narrows intergovernmental-agreement option, approves ordinance amending letter-of-credit rules

The Village of Sugar Grove Board of Trustees voted to approve an ordinance amending local development rules to permit a developer or subprovider to use an intergovernmental agreement (IGA) in place of a letter of credit, provided the IGA is approved by the village board. The board amended the proposal to limit that option to Sugar Grove tax bodies only.
Staff presented the proposed text amendments and recommended approval. Trustees discussed whether the village should retain the letter-of-credit requirement in some circumstances and whether the board needed to reserve discretion to require a letter of credit for specific projects, such as parcels near the airport that require village permits. A trustee asked whether the proposed ordinance language would need future changes to allow an arbitration committee; staff said arbitration language could be inserted into the agreement if the board wished.
Trustees Michael (mover) and Roskoff (second) amended the motion during debate to specify the waiver of the letter-of-credit requirement apply only to Sugar Grove tax bodies. The board conducted a roll-call on the amended motion; trustees present voted in favor and the chair announced the ordinance approved.
The ordinance as amended allows, at the village board’s discretion, an IGA in place of a letter of credit for local-government entities specified in the amendment. Staff clarified that the change does not remove other bond or guarantee requirements: stormwater and other improvement guarantees remain subject to existing requirements. The board’s vote followed a brief legal and procedural discussion about how outside government bodies would request a waiver and whether each request should come before the village board for approval.
The approved motion and amended language mean outside government bodies may request that the village accept an IGA rather than a developer-provided letter of credit, but the board retains the option to require a letter of credit on a case-by-case basis and will consider requests from other taxing bodies individually.
