DOE proposes assessment rules for private schools receiving scholarship funds

The Nevada Department of Education presented draft changes to NAC 388D on Oct. 20, 2025, clarifying assessment requirements for students in private schools that receive public funding through the Nevada Education Choice Scholarship program.
Administrator Peter Zutz explained that the proposed NAC language would require private schools receiving scholarship funds to administer assessments that adhere to state and federal accountability laws and policies, including English language proficiency assessments, college- and career-readiness assessments, criterion-referenced assessments in mathematics, English language arts and science, and alternative assessments for students with severe disabilities. Zutz said the Department would perform on-site administration monitoring and require reporting of assessment irregularities for private schools administering state assessments to meet NRS requirements.
Why this matters: The proposal would align assessment expectations for privately operated scholarship-funded programs with state accountability systems and give the Department monitoring authority when state assessments are administered in private settings.
Public comment: No in-person or online public comments were received for this item during the workshop. The Department noted the proposed language appears in the information packet and provided a high-level list of the assessment categories that would be required.
Next steps: The workshop closed after the presentation; the Department will proceed with formal rulemaking steps for NAC 388D.
