The Board of Appeals granted a finding under Table 2 allowing a side setback encroachment for a proposed addition at 36 Sherwood Avenue. Applicant Hillary Gordon told the board she is seeking the addition to create a playroom for a family with four children and explained the addition would encroach to 13.37 feet where 15 feet is required.
Planning staff explained the current overhang is approximately 12.8 feet and that the proposed addition would not increase the nonconformity beyond existing conditions in a way that is substantially more detrimental to the neighborhood. The property is also subject to Conservation Commission review because it sits near Frost Fish Brook; the applicant noted concom (Conservation Commission) permitting is in process and the site will require a stormwater permit as part of the work.
Board members who visited the property observed the adjacent lots and heard from the applicant that immediate neighbors had been contacted and raised no objection. Several board members praised the quality of the work on the house and voted to approve the finding.
The board's motion found the proposed encroachment would not be substantially more detrimental than the existing structure. The finding passed unanimously among voting members present; one board member declined to vote on the matter.
