Fabens Independent School District’s Board of Trustees voted to join the Rate 41 group and retain special utility-rate counsel to intervene in an El Paso Electric Company rate proceeding before the Public Utility Commission of Texas.
The action was presented by Superintendent Dr. Segovia, who said the proposed changes by El Paso Electric “could possibly negatively impact governmental entities,” including school districts. The board considered an interlocal agreement to participate with other local public entities and an engagement letter for counsel K&L Gates LLP.
Dr. Segovia said the district would act as fiscal agent for its share of legal costs if it participates and gave an example provided in the packet: “If the total cost would be 100,000 in legal fees, 1.57% would be 1,570 dollars that we would commit.” The 1.57% figure was described as the district’s proportional share based on kilowatt usage.
Board members discussed logistics and fees. One trustee asked whether the proposed fee would be a one-time payment; Dr. Segovia said her understanding was the fee would be paid at the end of the case and offered to double-check. The motion to intervene was read into the record and the board approved participation and the engagement letter by voice vote.
The board’s approval authorizes Fabens ISD to participate in SOAH/PUC docket number 473-25-11219 as a member of the Rate 41 group and to contract with K&L Gates LLP to represent Rate 41 interests.
