State Board committee approves 2025—29 rule review schedule for SBOE rules

Christina Dela Fuentes, rulemaking director at the Texas Education Agency, presented the proposed 2025—29 rule review plan for the State Board of Education rules and asked the committee to approve it.
Dela Fuentes said state law requires agencies to conduct an ongoing review of rules and that the four-year schedule divides chapters for review by year. The plan does not include the Texas Essential Knowledge and Skills (TEKS), which are exempt from the rule-review requirement under the Education Code, she said. The handout she circulated added a column indicating whether chapters had been reviewed in accordance with the 2021—25 plan.
Committee members asked whether approving the plan would foreclose future changes; Dela Fuentes and Chair Francis clarified it would not. A rulemaking process can be opened at any time under the agency's operating rules, she said, and the plan can be updated and reposted when necessary. Member Childs asked whether the plan document in the agenda matched the handout; Dela Fuentes said the handout substituted for the status-report attachment and the only substantive addition to the plan was the new column indicating prior compliance with the 2021—25 plan.
A committee motion to approve the proposed 2025—29 rule review plan carried on an aye vote.
