Board adjourns Ewing application; staff to seek extension before potential dismissal

The Morris Township Board of Adjustment on June 23 adjourned the public hearing for the Ewing application after not all required parties were present. Board counsel informed members that the board has time to hear the application through July 31 and recommended scheduling it for the July meeting with an eye toward the August hearing date if extensions are obtained.
Board counsel told the board, “not all the parties who had to be at this hearing for mister Ewing's application were available this evening. So, we are going to adjourn this matter this evening.” The board discussed a July 28 hearing date and a later August 25 date as fallback.
The board directed staff to request an extension from the applicant so the matter can be scheduled at the July meeting. Board counsel said he would seek a further extension and that if an extension from one participant was not obtained, he would recommend dismissal of the application. The board did not take a final ruling on the merits at the June 23 meeting.
Board members discussed availability for the rescheduled hearing and noted that some participants (including at least one counsel) would not be available for the August date. A board member observed that members not present for the full hearing would need to “read the transcript and catch up.”
No motion on the merits was made or voted on; the action at the meeting was procedural scheduling and direction to staff to pursue an extension. The board will reconvene on the new hearing date only if the necessary waivers and availability are secured.
