Midway ISD board finds teacher abandoned contract, refers certification case to TEA

Midway Independent School District trustees voted Tuesday to find that teacher Aaron Brody abandoned his employment contract and authorized the superintendent to notify the Texas Education Agency, after administrators said Brody submitted a resignation after the district—s resignation deadline and did not return to work as required.
Dr. Knudson explained that Brody signed a contract for the coming year but resigned after the district—s June 30 deadline and did not report for duty on the first required day, Aug. 4. The administration recommended a finding of abandonment under Texas Education Code Section 21.21(c)(2) and 19 Texas Administrative Code 249.14(j), both of which were cited in the motion read into the record. Trustees voted unanimously to find abandonment and, in a second motion, authorized the superintendent to send a letter to the Texas Education Agency seeking sanction of Brody—s educator certification for abandonment of contract; that motion also passed unanimously.
Board members said they will continue to work with employees who resign for legitimate emergency reasons but that this case met the statutory threshold for abandonment. Administrators said the employee—s role (a DADP special education position) is important and that the district is taking steps to find alternative arrangements for affected students.
