East Dundee adopts ordinance banning intoxicating hemp and kratom sales to minors, effective July 1

Trustees for the Village of East Dundee voted to adopt an ordinance that prohibits the sale of intoxicating hemp and kratom products to persons under 21 and makes minor possession an ordinance violation.
The measure, moved and seconded during the May 19 regular meeting, includes an administrative implementation period: trustees amended the motion at staff request to set the ordinance’s effective date to July 1 to give local businesses time to adjust display and packaging practices.
The ordinance replaces earlier, less-defined local regulation of intoxicating hemp and kratom and clarifies enforcement. Trustee discussion noted the change creates an ordinance violation for a minor found in possession; staff said enforcement would use an ordinance citation similar to other local citations. Trustee questioning focused on penalties and on giving businesses time to comply.
Franco, a village staff member present during the discussion, asked trustees to adopt the July 1 effective date so the village can “have ample time to educate the business owners in the community and allow them time to purchase any glass cases or other types of displays that they want to comply with this.” Trustee comments included concern about how the rule would be applied to minors; staff confirmed violations would be handled as ordinance citations.
Trustees recorded unanimous support during the roll call. Staff and trustees said the village will publish guidance for businesses and that the July 1 date is intended to reduce immediate compliance burdens.
The ordinance language adopted by the board prohibits retail sales of intoxicating hemp and kratom to underage persons, makes minor possession unlawful under village code, and establishes ordinance-level penalties to be issued by citation. The village indicated it will produce outreach materials for affected retailers ahead of the effective date.
Trustee Mahoney, Trustee Oakland, Trustee Sauter, Trustee Saviano, Trustee Coonsie and Trustee Kunze voted yes on the motion to adopt the ordinance. No recorded votes against the ordinance were made during the meeting.
Village officials said the ordinance will be enforced through the village’s normal ordinance-citation processes and that the village will provide additional details about compliance and penalties to local retailers prior to July 1.
