The Mountain View School Board on Aug. 18 held a nonvoting first reading of a revised closed‑session bylaw intended to align the district’s rules with the Brown Act and model language from the California School Boards Association (CSBA).
Board staff said the existing closed‑session bylaw dated to 2017–2018 and was “very dated.” The proposed replacement, described at the meeting as board bylaw 93.21 (closed session), is more detailed about what may and may not be discussed in closed session and draws heavily on CSBA wording.
The board member who led the discussion said the revision “reiterates the open meetings statutes, otherwise known as the Brown Act,” and that no optional language from CSBA was added; CSBA’s model text provided the bulk of the update. Staff recommended that next week the board delete the older bylaw (referred to as bylaw 93.21.1) and replace it with the new 93.21 text.
One trustee asked whether any new closed‑session practices were being introduced; staff replied the proposed bylaw documents existing practice in more detail rather than altering how closed sessions have been conducted.
Because the item was presented as an informational, nonvoting first reading, the board took no formal vote on the bylaw at the Aug. 18 meeting. The board will consider formal action, including deletion of the older bylaw and adoption of the new text, at a subsequent meeting.
The bylaw discussion occurred during the business action section of the meeting and was introduced as a staff‑led item about updating outdated policy language to match the Brown Act and CSBA guidance.
