Story County supervisors approve vacation of two utility easements in O'Rourke Subdivision

The Story County Board of Supervisors on Aug. 26 approved Resolution 26‑06 to vacate two utility easements on part of Lot 2 of the O'Rourke Subdivision so the Rudpath family can reconfigure and expand the lot that contains their dwelling, county staff said.

County planning staff said the easements affected two parcels in the Rourke (O'Rourke) Subdivision near Cameron School and that existing utilities were moved into the public right of way before the vacation request. "They've already completed moving all the existing utilities that were in the easements into the right of way," a county staff member told the board.

Staff said one easement was a water line and the other was a five‑foot telephone easement granted to the county in 2011 that had never been used. The county notified property owners within 300 feet and published notice where required; staff reported that neighbors had signed to indicate approval.

With no public commenters, a board member moved approval of Resolution 26‑06, the motion was seconded, and Supervisors Merkin, Basil and Edens voted "aye," carrying the resolution. The board recorded no abstentions or dissenting votes.

If recorded, staff said, the easement descriptions will be removed from the property record and the Rudpath family may proceed with the lot reconfiguration and any related building permits subject to county permitting rules. The county identified no outstanding objections and said recording the vacation is the next administrative step.

The action occurred during a public hearing on the agenda; there were no public‑comment speakers on the item at the meeting.
