Board briefed on denied CPKC appeal, village moves to monitoring phase after STB outcome
Summary
Village staff reported the appeal related to CPKC was denied following a recent U.S. Supreme Court decision affecting NEPA review; the village said it exhausted appeal rights and will continue independent monitoring under terms set by the Surface Transportation Board (STB).

Village staff told the board July 1 that an appeal regarding the Canadian Pacific Kansas City (CPKC) matter was denied and the village will move to a monitoring phase. Staff said they had fully exercised appeal rights under the Surface Transportation Board process but a U.S. Supreme Court decision in May changed the legal landscape for NEPA review, affecting the appeal outcome.
Administrator Carrie Anne said the village's strategy had been a dual track: appeal the STB decision and prepare for local monitoring should appeals fail. "We fully exercised our appeal rights under the STB," she said, and the village will now proceed with independent monitoring to develop evidence for potential future STB review if needed. Staff said the village had preferred STB to complete certain analyses, but the STB declined, leaving municipalities to undertake monitoring.
The board received the update; no formal action was taken at the meeting. Staff said monitoring and evidence-gathering will continue and that they would inform residents about next steps.
