Staff said they had fully exercised appeal rights under the Surface Transportation Board process but a U.S. Supreme Court decision in May changed the legal landscape for NEPA review, affecting the appeal outcome.
Administrator Carrie Anne said the village's strategy had been a dual track: appeal the STB decision and prepare for local monitoring should appeals fail. "We fully exercised our appeal rights under the STB," she said, and the village will now proceed with independent monitoring to develop evidence for potential future STB review if needed. Staff said the village had preferred STB to complete certain analyses, but the STB declined, leaving municipalities to undertake monitoring.
The board received the update; no formal action was taken at the meeting. Staff said monitoring and evidence-gathering will continue and that they would inform residents about next steps.
