Board members reviewed a resignation letter from a licensee at Saltwater (and related establishments) and discussed Rule 26, which makes the licensee accountable for the acts of employees and the requirement that an approved licensee be on the license. Commissioners said the board is not compelled to automatically remove a named licensee after a 30-day notice; instead, the board can require that a new applicant be approved before allowing the departing individual to be taken off the license.
The board told the parties it expects any replacement application to be filed promptly and set an administrative target: applications should be in staff hands in time for the July hearing cycle, with the board requesting materials be submitted by June 6 for scheduling. Board counsel and staff said that if the licensee is removed and no approved replacement exists, the premises would not be authorized to serve alcoholic beverages.
Commissioners asked staff to notify the departing licensee and the restaurants' representative that the board's position is to keep the current licensee on the license until an approved replacement is in place, and that failure to secure a replacement will result in the prohibition of alcohol sales at the affected premises.
