Resident urges enforcement of developer agreements over sewer right‑of‑way for proposed Summerhill Phase II

Dennis Pavlik of 229 North Duane Drive told council that the upcoming Summerhill Phase II plan of lots abuts his property and would rely on a sewer right‑of‑way that runs down his private, single‑lane North Duane Drive. Pavlik told council residents there already have sewer service and that the municipality controls the right‑of‑way; he asked the municipality to enforce the developer's written commitments and to require the developer to include enforceable design and access drawings in the official plan before approval.
Pavlik said the developer has provided a written list of commitments addressing neighborhood concerns but has not executed a signed agreement. He asked council to treat the private road as if it were a municipal road when reviewing ingress/egress, and to ensure inspectors can enforce the developer's promises.
Council acknowledged receipt of Pavlik's email and materials and told him his concerns "will be noted when we're doing the conditional use hearing," indicating staff and council will include his materials in the record for the formal review. No action, approval or enforcement directive beyond including the comments in the conditional‑use record was taken at the meeting.
Pavlik also said he has emergency‑response considerations due to the one‑lane, dead‑end nature of North Duane Drive. Council did not commit to a specific remedy during the meeting but confirmed staff and the planning process will review and record his concerns for the conditional‑use hearing on Summerhill Phase II.
