The Delafield Common Council on March 3 voted to convene a closed session to consult with legal counsel about an impact-fee appeal filed by the Metropolitan Builders Association of Greater Milwaukee.
At about 7:26 p.m. the council moved into closed session under Wisconsin Statutes a7 19.85(1)(g), which permits conferring with legal counsel regarding litigation. The roll call vote showed Alderpersons Henry, Schaeffer, Valde, Wilkin, Grimmer, Price and Burke voting in favor; the presiding mayor led the session into closed session and the motion carried.
Earlier in the meeting, resident Aaron Warner used the citizens'comment period to voice strong support for the council's handling of the dispute with the Metropolitan Builders Association. "I support what you do and I hope you fight this vigorously," Warner said.
The council returned to open session at 8:08 p.m., and the mayor announced there would be no public discussion or action taken on matters discussed in closed session. Later in the meeting, the council held a second closed session under Wis. Stat. a7 19.85(1)(e) to discuss county fire-and-rescue funding options; that motion also passed by roll call and the body reconvened and adjourned for the night.
Records in the public record show the council used the statutory authority to confer with counsel; no other public votes or motions regarding the appeal were taken after the closed session.
