RDC approves temporary laydown agreement with BCM after adding return‑condition language and optional fencing

The Redevelopment Commission on July 21 approved Resolution 25-93, allowing Brinshore Construction Management (BCM) to use a lot west of the 714 property at Hopewell for laydown and temporary storage through Dec. 31, 2025, subject to revised contract language that requires BCM to return the property in the same or improved condition and encourages—but does not mandate—fencing at BCM’s discretion and expense.
Staff presented the agreement and a map. Commissioners raised concerns about restoration obligations and public safety for the laydown area. One commissioner requested explicit language requiring the tenant to restore the site "in the same shape in which they got it except for normal wear and tear;" staff said paragraph 11 was added to require BCM to return possession in the same or improved condition and that any improvements would need city staff approval. Paragraph 12 encourages BCM to provide fencing for public safety at their discretion; staff recorded BCM is responsible for any injury to the public.
Commissioners discussed whether requiring a fence would be cost-prohibitive for a short lease; staff said fencing could be the tenant’s prerogative and would typically be their expense. With the added language clarifying return condition and the fencing encouragement, the commission approved the resolution unanimously.
Staff said they will finalize the contract language before execution and monitor compliance during the laydown period.
