Commissioner Sean Reed said the Hamiltons had asked that their item not be heard on Sept. 8 and asked for a majority consensus to defer. Mortel and others recounted a conference call involving Florida Commerce and described competing versions of what was discussed, including whether the Hamiltons requested additional work outside the original scope and whether Florida Commerce had instructed the city on using some funds to remove a lien.
Mortel told the commission the CDBG grant must be completed by Jan. 1 and laid out a timeline: staff needs 30 days to publish an RFP and about 15 days for the applicant to select a contractor, meaning roughly 45 days of procurement work. Mortel warned that missing the deadlines could forfeit reimbursement eligibility. Commissioners discussed whether to let staff manage the procurement and grant process or to retain the matter for a public hearing so the Hamiltons could present their side.
After discussion, commissioners agreed to move the matter off the Sept. 8 agenda and tentatively schedule a presentation and public hearing on the August/September/October dates referenced in the meeting (the transcript records a consensus to look at "the 20 second" as the next available meeting, and later suggested October 13 or October 20 as possible dates). Commissioners asked staff to invite the Hamiltons to provide any materials in time for an agenda packet; staff noted the Hamiltons were not required to supply materials in advance but were welcome to do so.
Commissioners also debated the city's contractual relationship with Guardian, including whether Guardian may be terminated and whether payments already owed should be withheld. Commissioners and staff noted that terminating Guardian without a replacement contractor would create reporting and implementation problems under CDBG rules given the fast approaching deadline.
