Code board issues compliance deadlines and fines for multiple Lake Clarke Shores properties

Town of Lake Clarke Shores Code Enforcement Board members on Feb. 26 set compliance deadlines and authorized fines for several properties found in violation of town codes.
The board voted to find the owner of 7500 Westlake Drive (case 25-0013) in violation of section 10-91(a) for installing a fence without a town permit and ordered compliance by March 26, 2025; a daily fine of up to $50 may be imposed and a fine-assessment hearing is scheduled for March 26 if needed. Code enforcement officer Eric Richwagon testified that a building permit application and an engineer’s letter were in process; the board approved the order after hearing from the property owner, James Phillips.
The board received a status report for case 24-0345 and directed staff to return with an update at the March 26 meeting; that matter remains open pending an engineer’s letter. For case 24-0405 (an ongoing inoperable-vehicle/vehicle-repair violation), the board found the respondent failed to comply with a prior order dated Jan. 28, 2025, and imposed a daily fine of $250 commencing Feb. 26, 2025; the town’s costs in prosecuting the matter will be assessed as well.
Code enforcement staff presented case 24-0412 (7512 Westlake Drive) involving septic work observed without permits; the board found a violation of section 10-91(a), ordered compliance by March 7, 2025, and set a fine-assessment hearing for March 26 if the property remains out of compliance. Officer Richwagon said site photos showed disturbance next to the yard and that neither the property owner nor the health department had contacted staff.
The board also found a property at 7108 Venetian Way (case 25-0001) in violation of section 125-1100 for operating as an unregistered vacation rental without inspection. The board ordered compliance by March 14, 2025; a fine not to exceed $250 per day may be imposed and a fine-assessment hearing was calendared for March 26 if necessary. The property owner, Louis G. Gonzales, told staff he intends to register and complete required inspections.
In a case flagged as repeat violations, the board found NuaVe Mar LLC’s property at 7423 Clark Road (case 25-0046) in violation for a bathroom remodel done without permits and declared the respondent a repeat violator under Florida statute. The board imposed the maximum daily fine available under the town ordinance: $500 per day commencing Feb. 7, 2025, continuing until compliance is achieved. Staff noted multiple prior permit-related enforcement actions involving properties tied to the same owner.
Several matters were recorded as in compliance at the hearing: case 25-0014 and case 25-0045 were brought into compliance before the board; a complaint about an antique vehicle that neighbors found unsightly was confirmed by staff as a legally registered classic vehicle and marked in compliance.
Most motions were approved by voice vote. Where staff recommended additional inspection (for example, the building inspector visiting 7990 Westlake Drive and other sites), the board asked staff to schedule inspections and return with status reports at the March 26 meeting.
