The ordinance had been reviewed by the borough planning commission and the Lancaster County Planning Commission and was advertised under the Pennsylvania Municipalities Planning Code, Evan (Staff member) said during the hearing: "This is . . . an ordinance . . . This has gone through your local planning commission. It's gone through the Lancaster County planning commission, and has been advertised in accordance with the Pennsylvania Municipalities Planning Code."
Why it matters: the changes alter where several commercial uses may open in Clumber going forward. Council members said the ordinance clarifies where certain businesses may locate; Councilperson Kaufman praised the final language and thanked the planning commission for its input. Mary Wittenizer, a member of the borough planning commission, said she was glad the bodies worked together and highlighted a county finding that child day-care can now be accessory use across zoning districts, which the county commission "applauded" during review.
Key provisions and process details: the ordinance (1) revises permitted uses in the Light Business zoning district; (2) adds a definition for "data center" and clarifies dimensional requirements for package delivery/distribution uses; and (3) stipulates that new smoke shops and tattoo parlors must locate in the Highway Commercial District going forward, while existing businesses may remain in their current locations. Councilmembers and planning commission members noted the text does not set a quota for smoke shops; it only restricts their future locations.
Council approved the ordinance by roll call after the close of the public hearing; Councilperson Kaufman moved adoption and Councilperson Stahl seconded. The council clerk recorded the vote and the measure passed.
The ordinance text will be included in the meeting packet and posted online after the borough submits it for codification; staff said the ordinance will appear on the borough’s codified ordinances "relatively quickly" after submission. The council indicated that copies also are available in the meeting packet for those who asked.
