At the Eagle Point School District 9 work session, the district’s policy lead reported that the district will reinstate the July 2020 administrative rule (AR) implementing Title IX complaint procedures because the district did not have the AR in its current policy set and subsequent federal regulatory changes and a court decision left the 2024 updates invalid.
The presenter said the district initially did not receive the 2020 AR during a changeover of board secretaries and that the Oregon School Boards Association (OSBA) in November 2024 recommended revisions to align with then‑new federal Title IX rules. A January 29, 2025 district court decision in Kentucky invalidated the November 2024 federal updates, effectively returning applicable practice to the 2020 AR. The presenter said the district had not had to conduct a Title IX investigation requiring the AR but wants the administrative rule in place should such an investigation be necessary.
Staff explained that restoring the 2020 AR ensures the district follows correct identification processes, investigation procedures, corrective remedies, investigator assignment and appeal processes if a Title IX complaint arises. Because the AR is administrative and is already referenced by board policy, the presenter said no separate board vote is required; the AR will be added to the district’s administrative rules so the procedures are available if needed.
