The Village Board of the Village of Heartland voted to approve a resolution of necessity to begin eminent-domain proceedings concerning the vacant lot at 550 Hartbrook Drive.
Village staff explained the step initiates an appraisal process: the village will order an appraisal and deliver it to Waukesha State Bank, which then has up to 60 days to order and pay for its own appraisal. The village said it will pay for the bank's appraisal as required by state procedure; if the two sides cannot agree on a price the matter would proceed to court.
A staff presenter told the board the resolution and related documents were drafted by the law firm Von Briesen. The presenter framed the action as the next procedural step driven by a stated village public-safety need related to the property.
A representative of Waukesha State Bank attended but did not offer substantive comments during the hearing. The board approved the resolution on a motion; staff said additional costs, including appraisal and legal fees, are expected as the process proceeds.
Approval of the resolution does not transfer title; it only authorizes the village to begin statutory steps for acquisition. Staff said subsequent offers, negotiations and any court action will be returned to the board for approval as required.
