The Fountain City Council approved an amended and restated service plan for the Cross Creek Metropolitan District on Aug. 26, finding the updated plan complies with state review criteria and preserves the existing maximum operation and maintenance mill levy at 10 mills.
City planner Christy Martinez told council the change clarifies the district’s authority to impose an operations mill levy and “ensure the maximum operation and maintenance mill levy is still established at the 10 mills.” The district covers roughly 406 acres, including residential, commercial and open space north to Fountain Mesa Road and south to CNS Road.
Tate Crosby, outside counsel for the Cross Creek district, said the amended plan does not request a higher levy now and instead “requested that, in uniformity with the City of Fountain model service plan, that the district have the authority to adjust its mill levy in response to legislative and statutory changes or adjustments to, assessed valuation.” He described the language as a mechanism so the district can maintain revenue neutrality when legislative changes alter assessed valuation.
Council members asked whether the amended plan raised taxes immediately; staff and Crosby repeated that the district currently imposes 10 mills and that any future change is constrained by the service plan, prior electoral authorization and budget‑hearing requirements. Crosby noted the district must publish budget hearings and explain changes to the public; council does not directly approve future levy adjustments.
The council approved Resolution 25-036 on a 5-2 vote; Council member Duncan and Mayor Pro Tem Temrick voted no. The approval also acknowledged existing intergovernmental agreements between Cross Creek and adjacent districts, and staff said the district’s plan meets the nine statutory findings required for service plan approval under state law.
