The Board of Zoning Appeals granted two related variances Aug. 20, 2025, allowing reconfiguration of parcels at 844 and 888 Riverview Drive. The requests, filed by Robert C. Burns and Camille Caruso Weisz, would transfer a strip of land (including a driveway) so the drive would be by‑right on the receiving parcel rather than governed by a historic civil easement.
Planning staff presented the survey plat showing the parcel modifications and reported the reconfiguration would increase the lot area of 844 Riverview to approximately 5,100 square feet while reducing 888 Riverview’s lot area, leaving both parcels nonconforming to the 7,200-square-foot minimum by different degrees. Staff recommended approval and included the standard planning condition that future modifications comply with the code or return to the board.
Applicants and board members discussed the history of the deeded easement, which dates to a 1940 subdivision and is described in older deeds. Mr. Burns said the surviving grantor is out of state and the family sought to sell; he described the easement text as limited in scope. The board discussed alternatives, such as retaining the easement and rewriting maintenance terms, but agreed that reconfiguring parcels would remove the need for a continuing easement in practice and help marketability.
The board opened and closed the public hearings with no speakers and then voted to accept findings and grant the variances for each parcel. Mr. Thompson noted the approvals would reduce nonconformity for 844 by adding land and that the standard condition on future changes applies. Written notification will be issued within 7–10 business days; decisions are subject to a 30‑day appeal to the Circuit Court of Monongalia County and any work during that time is at the parties’ financial risk.
