At its Sept. 4 meeting the Fargo Planning Commission approved four separate minor subdivisions and replats that consolidate lots or remove recorded easements. Donald Kress of the Department of Planning and Development presented the items and recommended approval for each; no public opposition was recorded in notices and no speakers addressed the commission during the public hearings. Bison Run Addition (UMU zone) The commission approved a minor subdivision combining Lot 9 and portions of Lots 10 and 11 in Beardsley’s Addition into a single lot owned by Bison Run Rentals. Kress noted the property is in the University Mixed Use (UMU) zone, which carries a minimum-density standard; the applicants told the commission they had sought an economic incentive from the Economic Development Incentives Committee and that committee had conditionally approved the incentive pending the normal approval process. Nineteenth Avenue Storage replat Donald Kress explained the replat removes a tree-buffer easement that had been modified previously by covenant but remained on the recorded plat; because plat easements can be altered only by replat, the owner will record a new plat without the buffer and will dedicate a 10-foot strip of right-of-way. The property will continue to be zoned Alley Limited Industrial and the owner’s proposed storage use fits the zone. Family Health Care Center replat The commission approved a replat consolidating seven underlying downtown lots into a single property for Family Health Care Center. Kress said the applicant negotiated to acquire a narrow 2-foot-by-80.5-foot strip of adjacent property before recording and reran the plat to include that strip so the recorded plat matches current ownership. Buckholtz Industrial Addition (name change and replat) The commission approved a replat for an industrial property in the 1300 block of 40 Third Street North. Kress said the plat had previously been approved, but its name was too similar to a different plat already recorded in Cass County; the applicant renamed the plat “Buckholtz Industrial Addition” and resubmitted for recording. Votes and process Each item was discussed briefly, public hearings were opened and closed with no public speakers, and the commission moved and approved staff findings or motions as presented. Commissioners voted by roll call; minutes record the affirmative votes and “motion carries” language for each item. Ending The plats clear title and recordation issues and allow the applicants to proceed with future permits or redevelopment work under the recorded configurations. No appeal or protest was recorded in the meeting minutes.
