The Vanport County Commission on Sept. 2 approved a petition to vacate a roadway easement along a section line between Gear Trail and Harvest Lane in Wally Township after adjoining landowners signed a petition and confirmed they had been notified.
Steven Stavich, representing Wally Township and several property owners, told the board the petition covered the section line between Gear Trail and Harvest Lane and that adjoining landowners had signed. "I'm Steven Stavich. I got from, Wally Township, on the Wole Township Board. And, we're, I'm here representing a couple property owners that will are petitioning to vacate the roadway easement in postpart of the section line between Gear Trail and Fall Trail, Gear Trail and Harvest Lane, in Molly Township. I think everybody has the petition," he said.
County staff confirmed the required notices had been provided and that only two immediately adjacent landowners were on record as adjoining the proposed vacation. The county attorney advised that because adjacent owners had signed the petition, some additional notice requirements under county code were dispensed with and the board could consider the petition. The board approved the petition and a motion directing the state’s attorney to draft the order that will be recorded with the county recorder.
Why it matters: Vacating a section-line easement changes public access and title matters for adjacent private properties and must be recorded with the county recorder. The action begins the legal process to remove the easement from county records.
Staff will prepare and record the formal order reflecting the vacation.
