The Jefferson County Board on Tuesday continued consideration of an area-of-impact agreement with the City of Roberts after county legal counsel flagged an ambiguous clause that could be read as adopting Roberts’ municipal ordinances into the county’s impact-area provisions.
Planning staff presented the draft agreement and explained Appendix C lists specific development standards (road grid, sewer and water connection expectations) the county intends to enforce in the Roberts impact area. County counsel recommended clarifying language in Section 3.2 because, as drafted, it reads broadly: "The City of Roberts ordinances/codes as listed in Exhibit C ... shall apply in the Roberts area of impact." Legal staff said that wording could be interpreted as a wholesale adoption of city ordinances rather than a limited adoption of the specific items enumerated in Exhibit C.
Staff and the county attorney exchanged edits during the meeting. The board asked whether striking or revising Section 3.2 would require republishing or restarting the public-notice process. The attorney advised the change would likely be a minor revision that would not require full readvertising; staff requested time to confirm.
Commissioner discussion emphasized there was no intent to adopt the city's full ordinances; rather the county wants to ensure connectivity, sewer and water hookup expectations and compatible road design in the impact area. The board voted to continue the hearing to next Monday at 9:00 a.m. to allow legal staff and the City of Roberts to review proposed clarifying language.
Planning staff said they would work with counsel and Chase (county legal reviewer) to prepare redlined language for the Monday agenda. The item will return to the commission once city staff and county counsel concur on final wording.
