County staff briefed the Erie County Board of County Commissioners on Aug. 19 that several administrative issues remained on the final plat for the Mountain Vista regular Planned Unit Development (PUD) but that the issues could be resolved without delaying approval.
The board authorized the chair to sign the final plat after staff said the outstanding items appeared to be clerical or ministerial: an underlying LLC had filed articles of incorporation after the covenants, conditions and restrictions (CCRs) were signed, requiring re-signature and notary; a transfer of property into the newly formed entity; and a title-company signature block that county staff described as redundant because the attorney’s certificate already documents title review.
A county staff member said Ryan Callahan, the attorney for the property owner referred to as "Mr. Bean," contacted county staff and was unavailable that day but expected to resolve the administrative matters. Staff said they had researched the land use code and "title 30, title 38" and concluded that requiring both an attorney's signature and a title-company signature was redundant for many exempt plats and boundary adjustments. Staff asked the title company to remove a blank signature block to avoid clouding title.
Commissioners asked questions about the vicinity map image in the packet, which appeared blacked out in the PDF copy; staff confirmed the hard copy did not contain the blackout and said the issue appeared to be a scanning error by the surveyor. A motion to "request approval and authorization of chair's signature on the final plat of the Mountain Vista's regular PUD" was made, seconded and carried unanimously.
The board did not change substantive terms of the plat; staff said the remaining steps — re-notarizing CCRs, transferring property into the LLC and clarifying the title-company block — could be completed administratively without further board action.
