The Rosenberg City Council moved into an executive session to discuss a potential purchase, exchange or lease of property under Section 551.072 of the Texas Government Code, then returned to open session and took no action.
Presiding official announced the item as qualifying for an executive session and said the council should deliberate the “potential purchase exchange, lease or value of property pursuant to section 551.072 of the Texas Government Code.” The presiding official moved to go into executive session; another meeting participant seconded the motion. Seven members voted in favor to adjourn into executive session.
The council later returned to open session. “There is no action to take, so I move we adjourn,” the presiding official said, and the council voted to adjourn. No votes, directives to staff, contracts or agreements tied to the executive-session topic were reported in the public record during the meeting.
Under Texas law, Section 551.072 allows governmental bodies to meet in closed session to deliberate the purchase, exchange, lease or value of real property when public discussion would affect the price or other bargaining position. The council’s public statements identified Section 551.072 as the basis for the closed proceeding but did not disclose property details in open session.
