The filing had been submitted in advance of the meeting with the chair’s prior authorization; commissioners voted to ratify the county’s participation and opposition position.
Why it matters: Water court applications by outside municipal water providers can affect streamflows, water availability and downstream users. The county’s opposition preserves its right to contest claims and protects local water interests and planning priorities.
Background and action: County counsel explained the statement of opposition was due in late August and that, after consultation with the chair, staff filed the opposition subject to ratification at the Sept. 2 meeting. The board voted to ratify the previously filed opposition and to continue the county’s engagement in the case. The county’s water counsel and interim attorney participated in executive session with commissioners prior to the public ratification.
Next steps: County counsel will represent Chaffey County’s interests in the water court proceeding, coordinate with contracted water counsel and update commissioners on litigation strategy as the case moves forward.
