A proposed cannabis dispensary by NYCC 1, LLC seeking to occupy an industrial-zoned building on Route 109 went before the Town of Babylon Zoning Board of Appeals; the board reserved decision and kept the record open pending a fire marshal inspection and additional technical details.
Applicant counsel Brian Whelan told the board the use would conform to local limits on dispensary hours and that there would be no on-site consumption or events. He said the site would operate with 24-hour on-site security (a state requirement for cannabis retailers), extensive video monitoring and alarm systems, and that the applicant will tie monitoring into local police. Whelan stated the applicant would supply sprinkler upgrades and comply with planning-department-recommended site plans.
Board members required a fire marshal inspection before the ZBA could act. The board also discussed parking needs; the applicant requested relief from a 20-space parking requirement down to 16. Whelan said the property is in an industrial zone approved by the town board previously for cannabis uses, and noted state proximity rules had been considered in selecting the site.
The board noted letters of public opposition in the file. No final vote was taken; the ZBA asked the applicant to secure the fire marshal’s sign-off and return with any outstanding documents.
