The Town of Babylon Zoning Board of Appeals voted to approve applications 25143A and 25143B, allowing the subdivision of three existing lots into two buildable lots and the construction of two single-family, two-story homes in Wyandanch, with covenants and restrictions attached.
The board first adopted a negative declaration under the environmental review cited in the planning memo dated Aug. 20, 2025, then approved the subdivision with the covenants and restrictions listed in the planning memo, and with the additional condition that both new homes have crawl spaces (no basements). Counsel for the applicant, Thomas Montiglio Sr., agreed to the covenants and to the requirement that the dwellings be connected to the sewer system.
During the hearing, neighborhood questions were minimal. A nearby resident, Anne Stewart of Commonwealth Drive, asked whether the project meant two houses per lot; the applicant clarified the plan is two houses total (one on each newly drawn lot). The board recorded the approval and indicated all covenants would be enforced as conditions of approval.
Decision: the board’s motion to adopt the negative declaration and approve both applications passed; the record shows the board voted “Aye.” The applications were approved with the covenants and the condition of no basements and sewer hookup.
