City approves participation in two opioid settlement programs; one yields immediate small payment

City Attorney presented two proposed settlement participations relating to national opioid litigation. The first involved the Purdue Pharma bankruptcy plan and a settlement with the Sackler family; the attorney reported Virginia's allocation from that resolution is about $39,000,000 and said Lexington's expected share from that settlement is approximately $3,637,000, to be paid over the plan's payout schedule. The council voted unanimously to accept the Purdue bankruptcy plan and to authorize the city attorney and outside counsel to execute documents necessary to participate and release claims against the Sackler family.
The second settlement covered eight manufacturers (Alvogen, Amneal, Apotex, Hikma, Indivior, Mylan, Sun, and Zydus) totaling approximately $16,400,000 to Virginia; the attorney reported that Lexington's share from that settlement is about $15,000 and that a substantial portion of the manufacturers' payments will be paid up front. The council authorized participation and directed the city attorney and outside counsel to execute required documents and releases; that motion also passed unanimously.
Council thanked staff for advancing participation. The attorney noted outside counsel will handle settlement paperwork and distributions will follow the national settlement schedules. No additional local allocations or programmatic uses were decided at the meeting; participation authorizes Lexington to receive its share of proceeds under the national settlement frameworks.
