Kristen Eich confirmed that Circle K Stores Inc. at 1380 Holland Boulevard failed to meet a prior compliance deadline imposed in a prior Massey order and that fines would continue until the city verifies compliance. Assistant Fire Marshal Samuel Schaller said the initial ruling gave the owner 90 days to comply; the owner did not meet that deadline and fines of $50 per day began on July 22, 2025 and had accrued $1,850 as of Aug. 27.
Why it matters: Accrued fines reflect prolonged noncompliance with fire-safety permitting related to newly installed cooking equipment and electrical work.
Details: JB Morton, representing Circle K onsite, said the construction contractor left the project and Circle K has since reassigned project responsibilities and obtained architects and engineers to resubmit required plans. Morton asked for an extension and a halt to fines; Eich declined to extend the original compliance date and directed the owner to continue working with the building department. The magistrate admitted file and PowerPoint exhibits and ordered fines to continue until an affidavit of compliance is filed and verified by a fire inspector.
