Board member Ray Bello read a draft resolution that cited Section 43-74(a)(3) of the Yonkers zoning ordinance and said the board may consider factors including proximity to residential uses, mitigation methods for noise, litter and lighting, and security measures. The resolution referenced an incident log provided by the Yonkers Police Department (August 2022 to October 2024) and specifically noted an incident report dated June 19, 2025, together with planning-bureau materials and public hearing materials.
The motion to deny the 24-hour special-use permit was made and seconded in public session; the vote carried with one dissent (Ms. Forsberg). The applicant stated after the vote that his application had requested limited late-night hours (weekend 1:00 a.m. or 3:00 a.m.), not continuous 24-hour service; the chair clarified that the application as submitted (for hours after midnight) was denied and the applicant may consult planning staff about a revised application.
No permits were issued; the board directed the applicant to consult with planning staff to explore alternatives and next steps if he chooses to reapply.
