The Wimberley Board of Adjustment on June 24 voted to grant a variance (BOA25-001) to reduce the dominant-street setback from 30 feet to 20 feet for the property at 212 Loma Vista. The applicant sought the change so a home could be sited on the portion of the lot that lies outside the 100-year floodplain.
The board considered whether the application met the variance findings required by city code and proceeded through the prescribed criteria. City staff described the site as “almost wholly within the 100-year floodplain” and said the higher, buildable area is toward the back of the lot closest to Loma Vista, making the requested 10-foot encroachment necessary to place a dwelling outside the flood-prone portion.
Board members reviewed the five required findings for a variance, including whether special circumstances affected the property, whether the condition was self-imposed, whether the variance would preserve a substantial property right, and whether granting the variance would harm public health or welfare. The board answered those findings affirmatively and then voted to grant the variance.
The approval allows construction closer to the road so the proposed residence can be located on higher ground and outside the flood plain, as described in staff’s presentation. The applicant was identified in the record as Wayne Latchford representing owner Al Sander, who were both in attendance.
No public objections were recorded in the hearing record; staff said one neighboring property owner within 200 feet submitted a comment of no objection. The board did not attach additional special conditions to the variance at the meeting.
