WIMBERLEY, Texas — The Planning and Zoning Commission voted to recommend denial of a conditional use permit application (CUP 25‑012) that would have allowed a short‑term rental (Type 2, non‑owner occupied) at 275 Stoney Creek Meadow Drive.
Nathan, planning staff, told the commission the property is a two‑bedroom, single‑family house on a parcel just under half an acre, zoned R‑2; the applicant proposed a maximum occupancy of six guests and showed on‑site parking sufficient for the application. Nathan also said staff does not make a recommendation on short‑term rentals.
Deborah Hines, who said she holds title in trust for her aunt’s estate, told the commission she was seeking the permit to generate income to pay for her aunt’s ongoing nursing and medical care. “In renting it out on a short term basis, we can generate a significant income to offset most of her living costs and preserve what little savings she has left,” Hines said. She offered to accept a time‑limited condition or a clause to end the permitted use if the aunt dies.
Neighbors who live on the small, one‑lane cul‑de‑sac described past experience with an improperly operated short‑term rental and urged denial. Jennifer Reed said she is the adjacent neighbor and raised concerns about safety, late‑night noise, bright lights and maintenance. “I’m not interested in strangers coming in and out of my neighborhood,” Reed said. Perla Trevino, who lives next door, said the neighborhood consists of long‑term residents and described past guests leaving trash and driving at high speed; she said the street layout (one way in, one way out) increases safety concerns.
Commissioners noted the unanimity of neighborhood opposition and cited past incidents in the area as relevant context. One commissioner summarized the commission’s informal practice: strong neighborhood opposition commonly leads the commission to recommend denial even though the code does not require denial.
A motion to deny the CUP was made, seconded and approved by the commission. The denial is a recommendation to City Council; the council will make the final decision if the applicant seeks appeal or resubmission.
Next steps: the applicant may revise and reapply, appeal the recommendation to City Council, or pursue other options available under city code.
