The City of Smyrna License and Variance Board approved a variance (V25-080) on Aug. 27, 2025, allowing a roofed structure over an existing patio at 544 Crescent Tree Brook and reducing the rear setback from 15 feet to 11.1 feet. Caitlin Crowe, land services development coordinator for Smyrna's Community Development Department, presented the request and said staff supports approval with a standard condition.
Crowe explained the lot, in the Logan's Walk subdivision, is 0.13 acre and already has an at-grade patio that is allowed within the rear setback; adding a roof renders the area part of the house and therefore subject to setback rules. She noted the applicant will not increase impervious surface area by roofing the existing patio and recommended the minimum needed variance. "Since this patio was already existing and they're not increasing any impervious surface area, we do feel that this is the minimum variance needed," Crowe said.
Applicant Jacob Barker confirmed he understood the single standard condition and offered no additional details. No members of the public spoke for or against the request. The board voted to approve the variance; the approval is conditioned on substantial compliance with the submitted site plan and elevation.
