The Nashua Zoning Board of Adjustment on March 25 approved a special exception permitting an accessory in-law dwelling unit (ADU) in the basement of 94 Cherrywood Drive.
The board found the requested use is listed as a special exception under land use code section 190-15, table 15-1, number 3, and concluded by a 5-0 vote that the application met the required special-regulation criteria. The board recorded no evidence the ADU would create undue traffic, overload utilities, or impair public safety.
Mark Sychka, the owner and applicant, said he plans the ADU to accommodate elderly parents and described a proposed exterior path to provide separate access: “I can move in with them or they can move in with me, so that's really, motivation.” Board members asked about entrance and circulation; Mr. Sychka said the basement has sufficient space and that the unit would be reached via a side path around the house.
Members noted the applicant signed required special-regulation statements and that the ADU configuration is consistent with nearby properties (board comment referenced a similar setup at 92 Cherrywood Drive). JP Boucher seconded the motion to approve after Steve Lionel moved; the five members voting in favor were Josh Neely, JP Boucher, Robert Shaw, Steve Lionel and Joseph Patry.
The board reminded the applicant of the standard 30-day appeal period before the decision is final and encouraged contact with staff for procedural next steps.
