The Zoning Board of Adjustment on May 13 approved a special exception permitting a roof over an existing attached deck at 3 Bryant Road in the R-9 zone (Ward E), allowing a 5-foot encroachment into the required 30-foot rear-yard setback.
Applicant Jeff Colburn said the covered deck will let his family use the outdoor space in more weather and explained that the roof is intended as a weather cover, not an additional enclosed or storage space. “We spend a lot of time. Families come in and we spend a lot of time on the deck … we want to put a roof over that deck so that we’re protected from the elements and we can enjoy that space throughout the year,” Colburn said.
Board members noted the structure will not change the existing deck footprint and cited privacy and limited visibility from the street as reasons the project would not affect neighbors. Member JP Boucher characterized the property as private and said the addition would not intrude on nearby residents; Vice Chair Josh Neely said the deck is not visible from the street and therefore unlikely to affect neighbors.
The board moved and seconded findings that the special-exception criteria in Land Use Code Section 190-16(e)(3)(a) were satisfied and voted unanimously to approve the request. The chair reminded the applicant of the 30-day appeal period.
