The Nashua Zoning Board of Adjustment on June 10 granted a variance to the Eric P. Wolfe Revocable Trust at 39 Ald Street to encroach 6 feet into the required 10-foot front-yard setback on Burke Street to construct an exterior landing and steps providing ingress and egress to a second-floor unit.
Applicant Eric Wolfe said the new exterior entrance will create a private entry for second-floor tenants and allow the owner to isolate a first-floor room for an additional occupant. The board reviewed photographs and a plan showing a modest concrete landing and a short set of steps that would project slightly into the setback. Board members characterized the lot as irregular and noted screening features such as a stone wall that will minimize visual impact.
Vice Chair Josh Neely and other board members said the encroachment is minor given the lot configuration and neighboring properties with similar placement. The board found the variance would not be contrary to the public interest, that it preserved the spirit of the ordinance, and that strict conformity would cause unnecessary hardship given the irregular lot. The motion to approve passed unanimously. The board noted the 30-day appeal period before the decision becomes final.
