The board’s attorney, Del Weldon, read findings of fact supporting the variance, saying the grant would not be “injurious to public health, safety, morals, and general welfare of the community” because the applicant committed to static messages, full dimming and no flashing. Weldon also stated the monument sign would be integrated to match the architectural style of surrounding businesses and that the requested variance represented the smallest deviation possible from the code.
Board members voted by voice to accept the findings of fact and approve the variance. The motion to have the attorney read the findings was made from the dais and a subsequent motion to accept the findings and the variance passed on an aye voice vote; a roll-call tally was not recorded in the transcript.
During questions, Fogel described technical features: the LED message center can cycle slides, the customer controls how long each slide displays, and the display automatically reduces brightness at night (automatic dimming) and in low-light conditions. Board members noted the city sign code provision that disallows signs that “flash, rotate, or fluctuate in lighting” and the approval was conditioned on adherence to static messaging and dimming controls described at the meeting.
