The Board of Zoning Appeals on Aug. 5 approved a continuance for VAR-25-49, a request by the petitioner for a general-contractor use variance at the Blackwell property, 4810 South Old State Road 37. The petitioner filed the continuance request less than seven business days before the meeting, so the board considered and approved the continuance to the Sept. 8 BZA special meeting after finding just and good cause for the delay.
Planning staff told the board the property sustained significant tornado damage but could be rebuilt while the variance request concerned the intended commercial use of rebuilt structures. Staff said the petitioner requested a continuance in an email stating they needed more internal time to prepare and may have been uncertain of the next hearing date; the board moved the item to the top of new business initially but then accepted the continuance. The motion to continue the case to 09/08/2025 was approved unanimously, 4-0.
The board noted that if the petitioner wishes to proceed earlier they'd need to notify staff and meet advertising and filing deadlines; a continuance does not prejudice adjacent-property owners and preserves the petitioner’s opportunity to return prepared to present just and good cause for the variance request.
