The commission on Sept. 8 asked staff to return with proposed changes or options aimed specifically at front-stair setback requirements as the city experiences a wave of demolitions and rebuilds. Commissioner Marriott raised the issue after recent Board of Adjustment cases where owners sought variances for stair placement on elevated houses. Marriott and other commissioners said the city's setback rules were adopted when ground-level houses were the norm and that stair location for elevated single-story houses can make a meaningful difference in neighborhood character. Planning staff and Laura Canary, community development director, recommended the commission receive an initial presentation to give staff direction on scope and design options and suggested engaging the planning advisory board. Commissioners asked for a timely initial presentation; staff agreed to deliver an initial presentation in early October and to begin outreach with the planning board. Options discussed included a limited, measured relief that would allow stairs to encroach into the front setback under defined conditions (for example a defined maximum run or percentage) or a narrowly tailored temporary or emergency ordinance for hurricane-impacted homes to facilitate rebuilding. Staff cautioned that wholesale changes for new construction could require careful drafting to avoid unintended consequences and that any change would be brought back in ordinance form for commission adoption. Next steps: staff will prepare an initial draft and diagrams and present options in early October; the commission asked staff to prioritize the item because many demolitions and rebuilds are pending.
