Yadenborough council adopts Act 25 resolution as part of police accreditation steps

The Yadenborough Council on Aug. 14 unanimously adopted a resolution authorizing arrests without a warning under Pennsylvania Act 25 of 1995, a measure Police Chief Henry Giamarco said the department needs as part of its accreditation documentation.
Chief Giamarco told the council the resolution provides proof that the council authorizes officers to make arrests under the provisions enumerated in state law, which he summarized as covering probable cause arrests for certain public-order offenses, including disorderly conduct and obstruction of public passages.
The motion to adopt the resolution was moved and seconded and carried in a roll-call vote. Council members voting yes included Latoya Moreau (president), Liana Roachlout (vice president), Anton Truehart, Nicole Beattie, Michael Trent, Jesse Peaks and Lorraine Johnson. Giamarco said the vote was “one step closer to accreditation.”
Why it matters: The police department is nearing completion of its accreditation process; council adoption of the resolution provides an administrative record requested in accreditation reviews, according to the chief. The record of council action will be part of the materials accreditation reviewers examine.
The council also approved other police-related items at the meeting, including an amendment to the borough’s special-permit parking ordinance to allow ten overnight guest spaces in the Gunther Municipal Lot; that ordinance change will be advertised for consideration.
