The Tonganoxie City Council recessed into executive session on May 5 for preliminary discussion of a potential acquisition of real property for public use, citing K.S.A. 75-4319(b)(6). Councilmember McCutcheon moved the council into executive session and identified attendees to include the city manager, assistant city manager, city clerk and city attorney; Councilmember Dale seconded the motion.
Mayor David Fries later stated on the record that no binding action was taken during the executive session. The council did not disclose additional details about the property discussion in open session. The motion to enter executive session and the council’s recorded statement that no binding action occurred were the only formal public actions related to the closed discussion.
Earlier in the meeting, the mayor also raised traffic concerns near the school and said he favors pursuing a shared solution with the school district, including the possibility of a roundabout; he said he was "ready to talk whenever they're ready to talk." That comment was made during mayoral remarks and was not presented as a formal council direction or decision on the property matter discussed in executive session.
The council adjourned after reconvening from executive session; there was no public vote recorded on property acquisition.
